The prizes available to be won in this promotion are arranged, fulfilled and delivered, in the case of Tier 1 Prizes, by Element London Limited (company number 7073848) with registered office at 5 Morie Street, London SW18 1SL (Element London) and in the case of Tier 2 Prizes by Michael Davies and Associates Limited (company number 02165614) of Walker Park, Blackburn BB1 2LG (STACI).

Privacy Policy

How altavia.hrg, Element London and STACI will use your personal data:

1. The personal data that you provide in connection with this promotion will be used by altavia.hrg for the purposes of administering the promotion, verifying the eligibility of entrants and selecting and contacting the winners, all in accordance with the terms and conditions of this promotion below (“Terms and Conditions”).

2. If you win a prize, altavia.hrg will:

1. 1. make your name and county available, as a winner, to people requesting that information in accordance with the Terms and Conditions and as required by the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing. If you do not want your name to be made available, please inform altavia.hrg using the contact details in paragraph 9 of this Privacy Policy. Note that, if requested to do so, altaiva.hrg may still, on behalf of the Promoter, share winners’ details with the Advertising Standards Authority;

1. 2. if you win a Tier 1 Prize, share the personal data that you have provided in connection with this promotion with Element London; and

1. 3. if you win a Tier 2 Prize, share the personal data that you have provided in connection with this promotion with STACI.

3. If you win a prize, altavia.hrg, Element London and STACI will process your personal data (and, if applicable, the personal data of your guest) provided in connection with this promotion only for the purposes of prize fulfilment and delivery.

4. The Terms and Conditions are the legal basis for the processing of your personal data by Element London, altavia.hrg and STACI. If you do not provide your personal data:

1. 1. altavia.hrg cannot process your entry, enter you in to the promotion or notify you if you win a prize; and

1. 2. none of altavia.hrg, Element London or STACI can provide you (or your guest if applicable) with a prize in accordance with their obligations under the Terms and Conditions. If your guest does not provide their personal data, then they cannot be included in the prize.

5. altavia.hrg will not disclose or share your personal data with any third party other than Element London, STACI, those who are engaged by altavia.hrg to administer the promotion and third parties who request details of the winners of this promotion as described at paragraph 2(a) of this Privacy Policy. None of altavia.hrg, Element London or STACI will disclose or share your personal data (or the personal data of your guest where applicable) with any third party other than those who are engaged by altavia.hrg, Element London and/or STACI to fulfil and deliver the prizes.

6. Your personal data (and, if you are a winner, the personal data of your guest) may need to be sent to countries outside of the UK in order to conduct aspects of the promotion (e.g. where fulfilment of the prize happens in another country). Where this occurs, altavia.hrg, Element London and STACI will each ensure that any transfer happens in accordance with applicable law.

7. altavia.hrg will delete your personal data promptly after the prizes have been awarded and distributed. If you are a winner, altavia.hrg will delete your personal data promptly after the period for requesting winners’ details (as described at paragraph 2(a) of this Privacy Policy) has expired. If you are successful in winning a prize (or you are a guest of a winner), then HRG and/or STACI will not keep your personal data for any longer than they need to, either to comply with the law or to fulfil their obligations to you and other third parties. 8. In accordance with the applicable data protection laws and regulations, you are reminded that you and your guest may at any time exercise your rights of access, rectification, deletion, limitation of treatment, opposition to treatment, including a right to require that your personal data is erased (but note that this will automatically remove your entry from the promotion (in the case of altavia.hrg) and, if you are a winner or a guest of a winner (in the case of Element London and/or STACI), will mean that you cannot receive or take up the prize), a right to amend your data and the right to ask to port (transfer) your data directly to another organisation.

Terms and Conditions

Eligibility

1. This promotion is open to all persons aged 18 or over and resident in the United Kingdom (excluding the Channel Islands), other than employees, and their immediate families, of the Promoter, its associated companies and anyone else professionally connected with this promotion (including, but not limited to altavia.hrg, Element London and STACI).

2. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld until the Promoter is satisfied with the verification.

How to Enter

3. You will require internet access and an email address to enter the promotion.

4. To enter the promotion you must, prior to the Closing Date, visit www.winwithwarsteiner.com (Microsite) and complete the online form by inserting your full name, email address and postal address.

5. Any instructions provided at the point of entry form part of the terms and conditions of this promotion. In the event of a conflict, these Terms and Conditions take precedence.

6. The entry period for the chance to win a Tier 1 or Tier 2 prize (as defined below) will run between the following dates (Promotional Period) 00:00 on  14thAugust 2023 and 23:59 on 31st October 2023 (Closing Date).

7. All entries must be received by the Promoter before expiry of the Closing Date.

8. Entries received after the Closing Date will not be accepted. The Promoter accepts no responsibility for entries that are lost, delayed, corrupted or not received either by the the Closing Date for any reason. Proof of sending shall not be deemed to be proof of receipt.

9. No more than 1 entry per email address per day will be accepted.  No more than one Tier 1 Prize and one Tier 2 Prize may be won per person.  Entries not complying with these Terms and Conditions will be invalid.

Prizes

10. There are two prize tiers available to be won:

1. 1. 5 x 2-night holidays to “Warsteiner World”, Germany for each winner and one guest, all prizes will be awarded within 7 days of the closing date 31st October 2023 by means of a random prize draw (Tier 1 Prizes, see paragraphs 11-16 and 21-26 for further details);

1. 2. 115 x Warsteiner branded accessory prize kits to be awarded by means of randomly pre-determined Winning Moments (as defined below), a minimum of one occurring every 2 days of the Promotional Period and the remainder will be randomly distributed and available to be won instantly online (Tier 2 Prizes, see paragraphs 17 and 27-30 for further details).

Tier 1 Prizes

11. There are five Tier 1 Prize packages available to be won, each consisting a two-night trip, including one night’s stay in Dusseldorf, Germany and a second night’s stay in Warstein, Germany for the winner and one guest (who must be aged 18 or older), departing on an agreed date between 1st- 18th December 2023. Each Tier 1 Prize package includes:

1. 1. pre-booked flights from London to Dusseldorf with hand luggage only. Return flight included. Element London (on behalf of the Promoter) will endeavour to book winners and their guests on direct flights wherever possible. Flights are however subject to booking availability and winners acknowledge that they may be offered indirect flights where circumstances make this necessary. There is no flight alternative;

1. 2. airport transfer from Dusseldorf Airport to and from the hotel;

1. 3. one night’s 4* accommodation in Dusseldorf based on sharing a double/twin room, including breakfast;

1. 4. one-way transfer from Dusseldorf to Warstein;

1. 5. one night’s traditional guest house accommodation in Warstein, based on sharing a double/twin room, including breakfast;

1. 6. tour of the Warsteiner Brewery;

1. 7. one-way private transfer from Warstein to Dusseldorf airport;

1. 8. £250 spending money.

12. Winners acknowledge that Tier 1 Prizes form part of a group trip. Both the travel and participation in any activities/experiences will be shared with other Tier 1 Prize winners and their guests.

13. All elements of each Tier 1 Prize will be booked by Element London and winners agree to provide reasonable assistance to Element London for this purpose. The winner may be required to provide a valid credit or debit card for security deposit purposes when checking in to the hotel and guest house. The Promoter shall not be responsible for any loss of the security deposit.

14. The winners and their guests must provide their own travel insurance and any necessary vaccinations, immunisations or similar and supply proof of insurance to Element London upon request. It is the responsibility of winners and their guests to ensure they obtain any additional insurance suitable to meet their personal needs (such as personal possession, mobile phone or gadget insurance) prior to travel. Both the winner and their guest must be legally able to travel to Germany on the date booked for travel (including, but not limited to, meeting any Covid-19 regulations / restrictions which apply), must hold a valid passport and obtain all necessary visas and other documentation (including, but not limited to, any Covid-19 documentation required at the date of travel). It is the responsibility of the winners and their guests to ensure that their passport will remain valid for a sufficient amount of time to permit entry to Germany on the date of travel. If unsure of the requirements, winners and their guests are advised to consult the guidance issued by HM Passport Office on the GOV.UK website.

15. All elements of the Tier 1 Prize must be taken at the same time and once booked, cannot be altered or amended. No element of the prize may be resold under any circumstances.

16. Any further details of Tier 1 Prizes will be confirmed when the winner is contacted by Element London.

Tier 2 Prizes

17. There are a total of 115 Tier 2 Prize kits available to be won during the Promotional Period, Each kit consisting of 1x Warsteiner overnight bag, 1 x Warsteiner cup and dice game, 1 x Warsteiner mini Tulpin set and 1 x Warsteiner key ring.

General

18. Unless otherwise stated, any expenses incurred by the winners and their guests in the general use and/or enjoyment of a prize (including, for example, for food and drink consumed outside of planned activities) are the sole responsibility of the winners and their guests.

19. The Promoter reserves the right to substitute an alternative prize of at least equal value if circumstances make this necessary.

20. All prizes are non-transferable and no cash or other alternative will be offered. It is the responsibility of the winner to ensure that the prize can be used by the winner (and their guest if applicable).

Winner Selection, Notification and Claiming

Tier 1 Prizes

21. The five winners will be drawn on Wednesday 1st November 2023.

22. The winners will be the first five entries drawn at random from all valid entries received during the Promotional Period by a computer process that produces verifiably random results. altavia.hrg will contact the winners within 48 hours of the draw taking place using the contact details provided by the winners on the Microsite to enter the promotion.

23. If the winner and/or their guest is unable to travel on the date offered to the winner, the prize may be forfeited and a replacement winner drawn at the Promoter’s sole discretion.

24. Winners of Tier 1 Prizes and their guests must be aged 18 years or older. altavia.hrg reserves the right to verify the age of the winners and their guests by requesting copies of valid photo identification. If such identification shows that the winner is under 18 years old, the prize will be forfeited. If identification provided for a winner’s guest shows that the guest is under 18 years old, the winner will be asked to nominate a replacement guest who is aged 18 or older. Any failure by the winner to respond to requests for guest nomination or identification may result in the prize being forfeited.

25. In order to claim a Tier 1 Prize, winners must provide Element London with copies of the winner’s and their guest’s passports confirming that the winner and their guest are aged at least 18 years or older and are able to travel, within 5 days of being contacted to enable Element London to book the prize:

26. If a Tier 1 Prize is declined, the winner cannot take up the prize or the winner fails to claim the prize as required by paragraph 25 above, that Tier 1 Prize will be forfeited and a replacement winner may be drawn at the Promoter’s sole discretion. These Terms and Conditions will apply to any replacement winner.

Tier 2 Prizes

27. Tier 2 Prizes will be assigned to randomly pre-determined moments (hours, minutes, seconds), at least one of which will occur every two days of the Promotional Period (Winning Moments). The first entrant to submit a valid entry on the Microsite on or after the occurrence of a Winning Moment will be awarded the prize assigned to that Winning Moment. A total of 115 Winning Moments will occur during the Promotional Period.

28. If, for any reason, no valid entry is received between one Winning Moment and the next, the prize allocated to that Winning Moment will be rolled over to the next occurring Winning Moment. In this event, the first two entrants to submit a valid entry following the next occurring Winning Moment will each win a Tier 2 Prize.

29. Winners will be notified immediately on screen if they have won a Tier 2 Prize upon completing the online form on the Microsite and will be automatically redirected to the “winner’s area” of the Microsite, where instructions will be provided on how to claim their prize. Winners must confirm whether they wish to accept the prize and must comply with all instructions provided on the Microsite without navigating away from the “winner’s area” in order to claim their prize.

30. Tier 2 Prizes will be dispatched to the winners by Royal Mail to the address provided by the winners when claiming, within 28 days following the winner completing the claims process on the Microsite.

General

31. Insofar as is permitted by law, the Promoter, its associated companies and its agents will not in any circumstances be responsible or liable to compensate the winner (or any guest of the winner) or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or that of their employees. Your statutory rights are not affected.

32. Entrants who do not win a prize will not be contacted.

33. The Promoter shall not be responsible for any inability of a winner (or their guest if applicable) to take up a prize.

34. The Promoter reserves the right to suspend, cancel or amend the promotion and / or revise these terms and conditions at any time without giving prior notice and, by continuing to take part in the promotion subsequent to any revision, entrants shall be deemed to have agreed to the amended terms.

35. The Promoter and/or altavia.hrg may, in their sole discretion, disqualify entries deemed to be non-compliant with these terms and conditions or if it has any reason to believe that efforts have been made to distort the competitive process or spirit of the promotion. This includes any individual found to be attempting to circumvent this clause by tampering with the operation of the promotion, setting up multiple accounts or using multiple identities. No bulk, consumer group or third party entries will be accepted. The Promoter’s decision as to any aspect of this promotion is final. No correspondence will be entered into.

36. Entry into this promotion is deemed acceptance of these Terms and Conditions.

37. If any provision of these Terms and Conditions is held invalid, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

38. This promotion and all issues arising out of it shall be governed in accordance with English law and is subject to the exclusive jurisdiction of the English courts.
